Ex-minister kicked out of rented property

FORMER Cabinet minister Flora Buka who served in the late former President Robert Mugabe’s administration has been evicted from a property that she was renting in Hogerty Hill, Harare, over rental arrears.

Her eviction was through a High Court order.

Buka was renting the property for US$1 650 per month, and had defaulted for several months.

High Court judge, Justice Gladys Mhuri ordered Buka to leave the property within seven days of the order.

Justice Mhuri also ordered Buka to pay the sum of US$9 075 being the rental arrears accumulated from August last year to date.

She was also ordered to pay interest of 5% per annum from August last year to the date of payment in full, and also to pay the costs of suit.

The owner of the property, Tarwirei Kurisa had entered into a lease agreement with Buka, effective from December 2021 for a year up to December, 1, 2022.

The rentals were payable in advance, on the first day of each month.

 According to the lease agreement, a late charge fee of US$165 which is 10% of the rentals for each month was payable if rentals were paid five working days late, and that charge was considered as part of the rentals for that month.

“Despite several demands, the defendant (Buka) has failed and neglected to pay her monthly rentals for all these months from August last year up to date,” Kurisa said in his application

“The rentals for each month compounded to US$1 815 per month including the penalty fee of US$165 per month according to the item of the lease agreement. The lease agreement has since expired on December 1, 2022 and my prayer is that the defendant be evicted from the property and all those claiming occupation through her from the said property as there is no longer any basis for her to remain at the property,” he submitted.

Kurisa also claimed rentals for January this year as Buka is still in occupation of the house.

“l am also claiming all holding over rental arrears that are incurred from January 2023 since she is still occupying my property, and all holding over rental arrears incurred until the defendant vacates the property.

“I humbly pray that the defendant be ordered to pay costs on legal practitioner and client scale since defendant is refusing to vacate my property, and l had to pay legal fees in order to institute this present litigation.”
