HARARE, Feb. 25 (NewsDay Live) – Magistrate Apollonia Marutya yesterday postponed the case of Zimbabwe Independent editor Faith Zaba, who is jointly charged with AMH editor-in-chief Kholwani Nyathi with undermining President Emmerson Mnangagwa.
Marutya said the High Court had not ordered a stay of proceedings, but that she had the discretion to grant a postponement pending the outcome of a High Court review application.
She added that the matter could proceed in her absence if the High Court does not specifically order a stay of proceedings.
The case had previously been postponed while the court awaited the outcome of the High Court review.
Zaba and publisher Alpha Media Holdings (AMH), represented by editor-in-chief Kholwani Nyathi, are charged under Section 33 of the Criminal Law (Codification and Reform) Act with undermining the authority of or insulting the President.
The charge arises from a Muckraker column published in the Zimbabwe Independent in June 2025.
The State alleges that the June 27 column, titled When we become a mafia State, which referenced Zimbabwe’s alleged interference in neighbouring countries’ politics and claimed the government was “obsessed with keeping itself in power”, was intended to engender hostility towards Mnangagwa.
The case is set to resume on April 9.
