Messenger of Court Energy Pedzera and his team had just attached two Mazda T35 trucks, a Volvo horse with trailer and two D4D Toyotas at the company premises in Kwekwe when all hell broke loose.

Workers at the company which is involved in mining closed the gate and refused to let Pedzera leave with the property which had been attached over a $34 005 debt owed by the company to Tongogara Rural District Council.

Pedzera confirmed the incident saying his team had to leave the vehicles at the company premises to get police reinforcements after the security guard threatened to shoot anyone who insisted on driving out with the cars.

“We had to get police reinforcements before we finally executed the order which was granted by the Gweru Provincial Court on April 1 and enforced by us on April 17,” said Pedzera, who is now holding the attached property for auction.

Tongogara Rural District Council, which is being represented by Chitere, Chidawanyika and Partners legal firm, secured a writ of execution against Refuse Mine, which is owned by Techmate Engineering, in case 264/15.

The initial debt which Techmate Engineering owes the council was $23 609, but ballooned to $34 000 due to $7 072 in interest accrued between 2009 and 2014.

The debt could also further rise owing to other charges including the fees for the Messenger of Court and other legal fees which continue to accrue.

“The debt according to our calculations is $34 005. This figure is exclusive of further costs of execution and interest thereon at the rate of 5% per annum calculated from this date until date of payment together with your Messenger of Court execution costs,” wrote Chitere, Chidawanyika and Partners. The property will go under the hammer if Techmate Engineering falls to settle the debt within 14 days.
