A Bulawayo businessman and medical doctor — Tanius Mumbengegwi — is facing civil imprisonment over a debt of over $24 000 for beverages which were supplied by Delta Beverages to his now defunct nightspot — Khami Bar — two years ago.
Khami Bar folded late last year and the night spot is now being run by another proprietor.
Mumbengegwi also operates surgeries in the city. According to summons of civil imprisonment and the order sought by Delta Beverages, which was filed by lawyer Ndabezinhle Mazibuko, the beverages company is seeking to have Mumbengegwi imprisoned at Bulawayo Prison, popularly known as “Grey Prison”.
Delta wants Mumbengegwi jailed unless he paid $24, 495,57 and interest according to a September 2011 ruling by High Court judge Justice Lawrence Kamocha.
The interest would be calculated at the prescribed rate from January 2001 until Mumbengegwi settles the debt. He will also be expected to pay the costs of the civil imprisonment. Delta had to apply for a writ of attachment of movable property after Justice Kamocha’s ruling and it was granted on October 12, the same year.
But on December 21, the Deputy Sheriff of the High Court in his return of service after visiting Khami Bar to attach Mumbengewi’s property reported that he found nothing attachable which could cover the debt.
This prompted Delta to approach the courts in January this year, seeking Mumbengegwi’s imprisonment.
On February 24, the matter was set down for hearing on March 8, but was postponed to March 22.

If Delta successfully moves the motion of Mumbengegwi’s imprisonment, a writ of personal attachment will be issued and the doctor will be seized and locked up.
