Mark Choga (33), commissioner in charge of finance, had appeared before magistrate Florence Nago facing charges of assaulting former council workers’ secretary-general, Frank Muzorera, at the mayor’s parlour in February this year. Nago yesterday said she would deliver judgment on August 29.

Muzorera claimed that Choga assaulted him all over, resulting in him sustaining injuries on the neck and left shoulder.

But Choga in his defence said Muzorera insulted, pushed and blocked him from leaving the mayor’s parlour after the chairperson of the residents’ association, Cornelia Selipiwe, had asked him to excuse himself.

State witnesses corroborated Muzorera’s claims, saying they saw him being assaulted by Choga.

On the other hand, Choga’s defence witnesses said it was Muzorera who assaulted the accused although they gave different versions of what had transpired.

The alleged assault occurred when Muzorera asked Choga how much commissioners earned as allowances and why they were not implementing the recommendations of a government audit report conducted at the local authority. “The accused person refused to answer the questions posed by the complainant and a misunderstanding arose and the accused proceeded to where the complainant was (seated) and hit him from behind once on the shoulder and neck,” the court heard.

“The complainant fell down and the accused person further kicked the complainant all over the body.”
