Wadzanai Mabika (41) was sentenced by provincial magistrate, Tendai Mahwe after he pleaded guilty to culpable homicide and five counts of contravening the Road Traffic Act.

Besides the jail term, Mabika was further prohibited from driving for a period of two years and had his licence cancelled by provincial magistrate, Elijah Makomo.

Mabika, through his lawyer, Nathaniel Chigoro, had earlier pleaded for a lenient sentence, saying he did not intend to flee from the accident scene, but panicked out of fear of mob justice.

He told the court his family was prepared to re-imburse funeral expenses incurred by the deceased’s family and was also “prepared for any other talks”.

Mabika admitted he was speeding on the day in question, adding he ran over the deceased and another pedestrian, Odwell Mabanga (35), who was seriously injured in the accident, while trying to avoid another vehicle that was reversing.

Lionella Chitanda appeared for the State.
