Murengwa is alleged to have sped off from Fourth Street bus terminus to Chiremba Road while Constable Walton Chiyangwa was clinging to the bonnet of his Toyota Raum after efforts to stop and arrest him for loading passengers at undesignated point in town failed.

His application will be heard today.

According to State papers, Chiyangwa later fell onto the tarmac and sustained head injuries, bruises on both hands and a fractured right leg after Murengwa deliberately sideswiped a Nissan X-Trail travelling in the same direction with him along Chiremba Road.

Chiyangwa succumbed to the injuries on the same day at Parirenyatwa Hospital.

This happened on February 16 this year, but Murengwa was arrested on April 24.

The State alleges that on the day in question, Chiyangwa was deployed at the Fourth Street bus terminus in the company of Constable Stephen Ganyani to arrest pirate taxis.

At around 3pm, Chiyangwa, who was still on deployment, stopped Murengwa to arrest him for loading passengers at an undesignated point along Robert Mugabe Road.

Murengwa, who was in the company of his accomplices identified only as Dumba, Sabhuku and Zivanai, did not comply with Chiyangwa’s instructions, but instead sped off towards him as the officer was in front of the vehicle.

The State alleges Chiyangwa was knocked down and thrown onto the bonnet of the moving vehicle. Despite the incident, it is alleged Murengwa did not stop, but proceeded into Robert Mugabe Road due east, as Chiyangwa clung onto the bonnet of the vehicle.

On approaching the intersection of Robert Mugabe Road and Chiremba Road, the State alleges, Murengwa sideswiped a Nissan X-Trail and in the process Chiyangwa fell onto the tarmac and sustained injuries, leading to his death.
