Harare-based company has approached the High Court seeking an order compelling the Zimbabwe School Examinations Council to pay $48 841

Harare-based company, Amandiz Architect (Pvt) Ltd, has approached the High Court seeking an order compelling the Zimbabwe School Examinations Council (Zimsec) to pay $48 841 which the examination body owes for architectural drawings for its Mutare regional office.

In case HC 11713/15 and through their lawyers, Gutu Chikowero and Partners, Amandiz Architect allege that in November 2006 they were given a contract to design the Zimsec Mutare offices which they duly fulfilled, but payment was still to be made.

“Payment of the sum of $48 841,18 due to the plaintiff (Amandiz Architect Pvt Ltd) by the defendant (Zimsec), being an outstanding amount for the plaintiff’s architectural professional services rendered to the defendant in the construction of the defendant’s Mutare regional office sometime in 2006,” read the summons commencing action.

Amandiz Architect submitted that the examinations body had breached the contract by failing to make good the debt and should therefore be forced to pay.

“Defendant breached the agreement by failing to timeously pay the plaintiff as and when payment became due.

“Over the years and up until the beginning of 2015, defendant has been acknowledging its indebtedness to plaintiff,” read the summons which were served on Zimsec last Friday.

Lawyer Adam Wenyimo said even though the debt was incurred during the Zimdollar era, his client and Zimsec met in 2010 and presented new quotes for the job which amounted to the claim that they were now putting before the High Court.

“The figures were not plucked from thin air, but this was a result of a meeting held in 2010 and at that meeting a USD quotation was made and agreed upon,” he said.

Wenyimo said his client would be demanding that Zimsec pays its dues with a 5% interest per year including legal fees.
