A LOCAL high-voltage maintenance and construction services firm, Power Network Projects, has taken beverages manufacturer, Delta Beverages, to court seeking to recover over $25 000 for services allegedly rendered at National Breweries’ main depot in Harare.

The parties are set to appear for the pre-trial conference hearing today before High Court judge Justice Priscilla Chigumba.
In the court case, Power Network Projects, represented by Cuthbert Mpame and Associates legal firm, is accusing Delta Beverages of prematurely terminating its contract at National Breweries after doing the bulk of the work it had been engaged for.
The firm claims Delta Beverages was to blame for the unfinished job after delaying in organising a shutdown necessary for the completion of the work.
“Defendant (Delta Beverages) was to pay ($36 000) for services rendered by plaintiff (Power Network Projects) upon being furnished with an invoice by plaintiff,” Mpame said.
“Plaintiff duly carried out the electrical works as agreed. However, as plaintiff was nearing completion of the services, defendant’s company delayed in organising a shutdown necessary for the work to be completed.”
Mpame said his client raised concerns with Delta Beverages over the delays, but the company was unresponsive.

“Plaintiff was thereafter surprised to see an advertisement in a local newspaper flighted by defendant for the same works and enquired from defendant about the same, whereupon defendant requested plaintiff to also respond to the advertisement,” the lawyer said.
Feeling cheated and let down, Power Network Projects is said to have refused to respond to the advertisement, but instead raised its invoice for the work it had carried out and presented it to Delta Beverages for payment.
“Despite repeated demand, defendant has neglected, failed and/or refused to pay plaintiff the said sum of $25 760 which sum is now due and payable,” the lawyers said.
However, after receiving the summons, Delta Beverages entered its appearance to defend notice.
