LUPANE – A former Kusile Rural District Council employee was yesterday sentenced to a wholly suspended two-month jail term for defrauding his employer of $1 920.

  Mandla Moyo, who was employed as a revenue clerk at the council offices, was convicted of fraud when he appeared before Lupane magistrate Takudzwa Gwazemba last week before he was sentenced yesterday.

  However, his sentence was wholly suspended for five years on condition of good behaviour.

  In suspending the sentence, the court noted that although Moyo participated in the fraud case, the State had proved that he did not directly benefit from the offence.

  Moyo’s sentence came a week after his co-accused, Jabulani Sibanda, a book keeper at the same council, was acquitted for lack of evidence.

  A few weeks ago, Moyo’s other accomplice Permanent Sibanda, a former Sports and Recreation Commission (SRC) regional coordinator, was convicted and fined $300 over the same offence.

  During his trial, Sibanda told the court that Moyo gave him 10 blank receipts to fill in purporting to have paid his office rentals to the council.

  The court heard this happened between June 2010 and July 2011.

  Sibanda then withdrew $1 920 from the SRC account claiming it was for rental payments and later converted it to his own use.

  Council officials discovered the fraud when they visited the SRC offices to ask for proof of rentals payment and an SRC official at the offices produced the fraudulent receipts. This led to the arrest of Sibanda and Moyo.
