A disc jockey (DJ) at Kudu Inn Sports Bar in Harare entered 2012 in saddening style when he was bashed by his manager for playing “unentertaining music” to revellers celebrating New Year at the popular joint.

The incident which left patrons shocked will, however, haunt the 40-year-old manager, Jerard Matutu, who was slapped with a three-year jail term by Harare magistrate Sandra Mupindu for inflicting serious injuries on Marvin Mudoka.

Matutu — who stays in Marlborough, Harare — and Mudoka are distant relatives.

Matutu approached Mudoka and instructed him to change the music at the bar as patrons wined and dined on New Year’s Day, but the DJ refused to comply with the manager’s instructions which did not go down well with him.

The court heard Matutu picked up an empty bottle, broke it and attacked Mudoka, causing injuries to his eye and at the back of the head.

The matter was reported to the police, leading to Matutu’s arrest.

He pleaded guilty to attacking Mudoka and the magistrate said his moral blameworthiness was very high and as such deserved a custodial sentence.

Prosecutor Moffat Makuvatsine urged the court to send a proper message to would-be offenders.

He said: “Of all the people who were in the bar, accused was the only person with the highest responsibility to maintain order and discipline. The assault was not called for as the complainant was playing music requested by patrons.”

Makuvatsine told the court the fact Matutu was not pleased with the music was not a justifiable reason to attack Mudoka and called for a prison term.

Matutu will, however, serve an effective 24-month jail term after 12 months were suspended on condition of good behaviour.
