Incarcerated Mthwakazi Liberation Front (MLF) leader Paul Siwela has deposited an affidavit at the Supreme Court giving assurances that he would not commit any offence of a treasonous nature.

Last Tuesday, Chief Justice Godfrey Chidyausiku ordered Siwela to deposit the affidavit as a precondition before his bail application could be heard at the Supreme Court.

Chidyausiku postponed the hearing of the case until the affidavit was deposited.

Siwela’s lawyer, Advocate Lucas Nkomo, yesterday confirmed the development in a telephone interview in Bulawayo.

“The affidavit was done and it was sent to the Supreme Court late on Friday. The Attorney General’s Office will be served within the next 24 hours and we will be waiting for their response.

Then upon the lapse of the 24 hours service to the AG’s Office that’s when we will be expecting to be furnished with the new hearing date,” said Nkomo.

Siwela has been languishing in remand prison for more than a month following his arrest on treason charges.

Siwela’s co-accused, John Gazi and Charles Thomas, were released last month on $2 000 bail accompanied by stringent reporting conditions.

Gazi’s family members paid his bail while Thomas was released four days later after he was bailed out by the Welshman Ncube-led MDC formation.

Siwela remained in prison after Justice Nicholas Ndou, who had earlier granted them bail, upheld his bail judgment on Gazi and Thomas and granted the State leave of appeal to the High Court against Siwela’s application.

In opposing bail, the State, represented by Martha Cheda, argued Siwela was a security risk.
