A Kwekwe engineering firm, Mild Engineering (Pvt) Ltd, risks losing its property which stands to be auctioned to settle a $3 000 debt owed to Clan Transport (Pvt) Ltd.

Clan Transport reportedly supplied goods worth $2 910,45 to the company in 2011, but has not been paid.
Mild Engineering, reportedly ignored repeated demands by Clan for payment, prompting the transport company to turn to the courts and obtaining a writ of execution on September 26 this year.
The writ of execution was granted by High Court judge Justice Francis Bere in case number HC1242/12.
“It is ordered that defendant pays the plaintiff the sum of $2 910, being value of goods sold to the defendent on credit.Defendant pays cost of suit on attorney and client scale,” Justice Bere ruled.

Clan Transport issued the summons through its lawyer Valentine Mutatu in January this year demanding payment, but Mild Engineering reportedly ignored the demand, forcing the company to make a chamber application for judgment in default of entry of appearance to defend.
Mutatu wrote to the company in October advising that a writ of execution against it was issued, but this was also reportedly ignored.
“If we do not receive payment within the next three days, we shall proceed to instruct the Deputy Sheriff to attach your property to recover same,” Mutatu wrote in a letter dated October 8.
