JOHANNESBURG – Acting Hawks head Major-General Berning Ntlemeza insists in court papers that his suspended Gauteng head should be charged with kidnapping and defeating the ends of justice, The Star reported yesterday.
There was a prima facie case against suspended Hawks boss Lt-Gen Anwa Dramat and suspended Gauteng head Maj-Gen Shadrack Sibiya, Maj-Gen Ntlemeza said in an affidavit opposing Maj-Gen Sibiya’s return to work.
Maj-Gen Ntlemeza said the two had a case to answer for the 2010 rendition of Zimbabwean nationals, the official reason for their suspension.
“I am satisfied that there is a compelling case for the applicant to answer to these heinous crimes,” Maj-Gen Ntlemeza said.

He was appealing against a court order declaring Maj-Gen Sibiya’s suspension illegal.
The court said the decision to suspend him was taken in bad faith because both the Independent Police Investigative Directorate (Ipid) and the Hawks’ integrity unit had cleared Maj-Gen Sibiya of being involved in the illegal rendition of Zimbabwean nationals.
But Maj-Gen Ntlemeza said judge Elias Matojane made “startling findings” in his ruling.
In 2010, five men, including Witness Ndeya, Gordon Dube and Pritchard Tshuma, were illegally repatriated to Zimbabwe by the Hawks.

In a draft report, Ipid found Lt-Gen Dramat and Maj-Gen Sibiya were directly involved in the renditions. According to the final report compiled in March 2014, they were cleared on the basis of additional evidence.
