NATIONAL airline, Air Zimbabwe (Pvt) Ltd, has taken a local company leasing one of its Harare buildings to court over rental arrears amounting to $29 000.

The airline wants its lease agreement with Chelnpac Investment (Pvt) Ltd cancelled and the latter evicted from the premises at 24 Cambridge Road, Avondale.
Through its lawyer, Mawere Sibanda, Air Zimbabwe said the firm had agreed to pay $1 600 in monthly rentals, but had accrued a debt of $29 094, as at November 30, 2016.
“In breach of the lease agreement, defendant (Chelnpac) has not been paying rentals to plaintiff (AirZim). As at November 30, 2016, the total accrued arrear rentals were in the sum of $29 094 (and) defendant has acknowledged the said debt,” Air Zimbabwe said.
“As a result of the breach aforesaid, on November 17, 2016, plaintiff cancelled the lease agreement and ordered defendant to vacate the property on or before November 30, 2016. Despite the cancellation of the lease agreement and the demand for payment of arrear rentals by plaintiff, defendant has failed and refused to pay the arrear rentals or vacate the property.”

Air Zimbabwe also said, as a result of the firm’s continued occupation of its property, it was suffering damages amounting to $1 600 every month, hence, the need to approach the court for recourse.
“Wherefore, the plaintiff claims an order confirming the cancellation of the lease agreement … and an order ejecting forthwith defendant and all those claiming occupation through it from plaintiff’s premises known as Number 24 Cambridge Road, Avondale, Harare,” the airline said.
Chelnpac has since filed defending papers at the court in readiness to defend its case.
