Zimbabwe Cricket (ZC) approached the High Court last week seeking an order to stop further attachment of its property after a former employee sought to attach more vehicles in to recover interest on an amount owed him.

Sometime in October 2012, the cricket body lost a labour dispute against its former employee, Andrew Muzamindo, who then obtained a writ for the recovery of $103 208 and was granted by High Court judge Justice Nicholas Mathonsi, granting him authority to attach the cricket body’s property.

Muzamindo then attached some vehicles, sold them for $95 158,57, leaving a balance of $8 170, which the cricket body settled on June 16 2015.

However, on July 17, 2015, the sheriff pounced again on Muzamindo’s instructions and attached more vehicles in a bid to recover the outstanding interest on the initial sum.

Muzamindo’s lawyer, Precious Garayi said section 5 of the Prescribed Rate of Interest Act provided that her client was entitled to claim his interest on the settled amount.

ZC lawyer, Tinashe Tanyanyiwa said Justice Mathonsi’s order was silent on the issue of interest and, therefore, Muzamindo would have to make a fresh application to recover it.
