A 31-year-old man from Chininga village will spend the next 40 days in jail for blocking two policemen from arresting his younger brother, who had been found in possession of dagga, a prohibited drug.

Smart Munkuli was convicted on his own plea of guilty to charges of defeating or obstructing the course of justice charges when he appeared before Binga magistrate Peter Tomupeyi Madiba yesterday. The magistrate slapped him with an effective 40-day jail term.

Last Thursday, Constables Phikelela Ncube and Sindiso Dube were on patrol at Chininga village when they met Smart’s younger brother, Oliver Munkuli. They told him he was under arrest for possessing two twists of mbanje.

As the policemen were about to handcuff Oliver, Smart pitched up and started pushing and shoving them until his younger brother escaped from the scene.

The cops instead turned their wrath on Smart and immediately arrested him for obstructing the course of justice.

In mitigation, Smart told the court he had committed the offence under the influence of alcohol. Bruce Maphosa represented the State.
