A Harare regional magistrate has sentenced two men to a total 17-year jail term after convicting them of attacking a local businessman before robbing him of $1 500 at gunpoint at his residence in Kuwadzana Extension.

Report by Charles Laiton Senior Court Reporter

Magistrate Estere Chivasa convicted Douglas Khumalo (26) and Samson Foya (36) of robbing Talkmore Foya, who is Khumalo’s cousin, and sentenced them to eight and nine years’ imprisonment respectively.

In passing sentence, Chivasa castigated Khumalo’s behaviour for setting armed robbers to attack his cousin.

“Against accused one (Khumalo) is the fact that he masterminded and co-ordinated the robbery.  He stole from a brother and that cannot be condoned at all.  His moral blameworthiness is high although he was not physically present during the robbery,” Chivasa said.

However, Khumalo will serve an effective five-year prison term after the magistrate suspended a year on condition he compensated his cousin in the sum of $532 and two years on good behaviour.
