HARARE magistrate Blessing Murwisi yesterday dismissed former boxing promoter Stalin Mau Mau’s application for bail pending appeal against his conviction and sentence for contravening traffic regulations.

Mau Mau was on October 16 ordered to perform 175 hours of unpaid work and fined $200 after he pleaded guilty to driving without a licence and negligent driving. In dismissing the application Murwisi noted that the appeal’s prospects for success were almost non-existent because Mau Mau was convicted on his own plea.

The 59–year–old Mau Mau wanted his conviction of driving without a licence and negligent driving set aside and that the matter be heard by a different magistrate. He said Murwisi erred in convicting him on both counts yet the record does not indicate that the essential elements of both offences were canvassed, put to him and admitted as required by the law.

He also said that the sentence imposed on the first count, of driving without a licence, was excessive for an elderly first offender.

The sentence to perform 175 hours of community service, he said, was harsh against the backdrop of his age. Barbra Ndoro prosecuted.
