A 32-YEAR-OLD Harare man, Kudzaishe Enock Moyo, who stole a gun and went on a robbery spree early this year stealing property worth over R69 000 and $4 500, has been freed by the magistrates’ court after being ruled an mentally unstable.

Moyo’s theft and armed robbery charges were on Wednesday withdrawn before plea by provincial magistrate Milton Serima after a medical report produced in court confirmed his mental status.
This was after his lawyer Ray Tsvakwi had written to the Prosecutor-General’s Office seeking his release on medical grounds.
“It is common cause that our client committed the offences of theft and armed robbery while in an unsound state of mind. The accused person was examined by two psychiatrists in terms of the Mental Health Act, namely Dr Kajawo and Dr Ncube who both concluded that our client was mentally disordered when he committed the said offence,” Tsvakwi wrote.
The court heard that sometime in February this year, Moyo — a former student at the University of South Africa — stole a gun from Brighton Ushendibaba, who is the director of a company called Panjap Motors.

The incident allegedly occurred when Moyo went to Panjap Motors enquiring about the price of a Nissan March where he was advised that it was going for $4 500.
After showing interest in the car, he offered to pay the cash, but while Mamutse was busy answering his phone, Moyo allegedly unlocked the vehicle doors, stole a Star pistol and a magazine with two rounds, which he used to commit a series of robberies.
