FOUR MDC–T activists accused of assaulting a fellow party member in April this year, yesterday told Harare magistrate Batanai Madzingira that they would file for refusal of further remand if their trial fails to commence on December 12.

The opposition party supporters are charged with allegedly assaulting MDC-T Harare provincial organising secretary Tichaona Munyanyi on April 10 this year before stealing his mobile phone valued at $300.
The suspects — Stewart Mukoyi, Francis Machimbidzofa, Rhino Mashaya and Denford Ngadziore — are currently on $200 bail each.
Speaking through their lawyer Douglas Mwonzora, the quartet expressed concern over delays in commencement of their trial.
“The trial for this matter has not been kicking off for one reason or another and we want to give notice that if on that date (December 12) trial fails to kick off, we will apply for refusal of further remand,” Mwonzora said.

Madzingira ruled that should there be no progress in the matter, the application for refusal of further remand would be granted.
The State alleges that the four committed the offences when Munyanyi reported at the party headquarters in Harare for a national council meeting.
Munyanyi was initially reportedly denied entry by a security officer, Lovejoy Chitegu Dunga, but managed to force his way into the room where the meeting was being held. Mukoyi and his alleged accomplices then pounced on Munyanyi and assaulted him indiscriminately.
