THE battle for control of a construction contract in Timire Park, Ruwa, escalated after Quality Paving and Construction filed a police report against Tatenda Machangu, owner of Talmach Civil and Plant Hire, accusing him of contempt of court.

The dispute stems from an ongoing High Court case in which Quality Paving and Construction sued Incredo Engineers (Pvt) Ltd and Shappenex Trading Company, accusing them of tampering with an agreement related to servicing Timire Park, a residential suburb in Ruwa.

Quality Paving and Construction is  being represented by Douglas Mwonzora of Mwonzora and Associates.

The company accuses Machangu, who was subcontracted by Shappenex to carry out construction work on the same land, of proceeding with work despite an existing contractual arrangement between Quality Paving and Construction and the land developers.

It has also opened a criminal docket against Machangu, accusing him of criminal trespass and cyberbullying. The matter is being investigated under RRB6810748 and CR40/6/26 at Ruwa Police Station.

According to High Court papers, in 2022 Quality Paving and Construction and Shappenex Trading Company entered into a contract for construction of roads and stormwater drains in phases 3 and 4 of the Timire Park Housing Development in Ruwa.

Following the agreement, Quality Paving and Construction took possession of the site in May 2022.

Under the contract, the company appointed Incredo Engineers (Pvt) Ltd as the consulting engineer for the project.

Although the contract stipulated that Shappenex Trading Company would pay US$100 000 at the commencement of the project, it allegedly failed to do so. The parties later negotiated alternative arrangements for raising funds.

Court papers state that Incredo Engineers supervised and approved work at every stage through its representatives, resulting in payment being made to Quality Paving and Construction.

It is further alleged that Quality Paving and Construction was consistently advised of delays and fully understood the causes of the project setbacks, while all work was periodically inspected and approved.

However, the plaintiff says it was “to its surprise” when, on February 24, 2026, Incredo Engineers issued a report alleging that delays were solely the fault of Quality Paving and Construction.

The report also claimed that the quality of work is poor, citing insufficient equipment and machinery and incorrect surfacing techniques.

It concluded that the plaintiff failed to execute the works in accordance with the contract and persistently and flagrantly neglected its obligations. It further recommended that the contract be terminated.

On March 30, 2026, Shappenex Trading Company issued a notice cancelling the contract.

Quality Paving and Construction has since contested the findings and recommendations in writing, but alleges that Shappenex indicated it is proceeding with the termination of the agreement.
