STATE Wants Mamombe Bail Revoked

STAFF REPORTERS

THE State has dragged Harare West legislator Joanna Mamombe to court accusing her of breaching her bail reporting conditions after she missed by a day.

The State alleges that Mamombe who was supposed to report to the police on August 27 as part of her bail conditions failed to do so and instead only came in on August 28, thereby violating her bail conditions.

It is the State’s case presented to magistrate Stanford Mambanje that on the 27th of August 2021 investigative officer Murimo who was the officer on duty realised that the accused had not reported as per her bail conditions.

“I was on duty from the 27th of August up to the 2nd of September, during this period I was to supervise the reported persons and that is when I realised that Mamombe had not reported at the station”.

The investigative officer submitted an affidavit that supported his testimony that the legislator had not reported to the police.

Mamombe’s lawyer Jeremiah Bhamu however opposed the placement of the affidavit as evidence saying the document was not valid.

He argued that the officer was the one who had commissioned the document and therefore he could not verify the facts contained in it.

The investigative officer told the court that Mamombe had not signed the form on August 27th but instead had done so on August 28.

In her defense, Mamombe through her lawyer said she had got stuck in the rural areas where she had gone to pick up her sister after government announced schools would open.

“The accused had gone to the rural areas to collect her younger sister who is an exam class but failed to beat curfew so she then reported to the CID law and order as early as she could,” said Bhamu.

Magistrate Stanford Mambanje deferred the matter to the 2nd of September 2021.

Mamombe stands accused together with the MDC Alliance acting chairperson Cecilia Chimbiri of allegedly participating in a public gathering with the intention of causing public violence.
