Mayor seeks magistrate’s recusal



SUSPENDED Harare mayor Jacob Mafume yesterday filed an application for recusal of magistrate Ngoni Nduna, saying he was partial and, therefore, could not preside over his trial where he is accused of obstructing the course of justice.

Mafume said Nduna could not preside over his trial since his views on the allegations levelled against him were different.

The State, however, said it would file its written responses to the application on Thursday.

Nduna said he would deliver the ruling on October 27.

Mafume is accused of obstructing or defeating the course of justice after he allegedly attempted to bribe a witness four days after he had been released on $30 000 bail by the High Court.

This pertained to a case where he is accused of parcelling out land illegally.

He is also alleged to have offered to pay US$1 500 to Edgar Dzehonye, a key witness, in the case so that he testifies in his favour.

As part of bail conditions, Mafume was ordered not to interfere with witnesses.
