CHITUNGWIZA Residents Trust (Chitrest) director Alice Kuveya was yesterday further remanded out of custody to July 12 by Chitungwiza magistrate Isheanesu Matova.

Kuveya was arrested last month during demolitions of illegal structures in Chitungwiza and charged with incitement to commit public violence, breach of peace and bigotry in terms of section 37 subsection 1 of the Criminal Law (Condification and Reform) Act.

Through her lawyer Fred Musarirevhu, Kuveya had challenged her placement on remand arguing that the message on the video, which led to her arrest, did not constitute an offence.

According to Musarirevhu, the application was granted with respect to the main charge.

However the magistrate placed her on remand on the alternative charge of incitement to commit public violence.

“The magistrate placed her on remand on the alternative charge of incitement to commit public violence. His reasoning was that in respect of the main charge, the statement does not invite anyone, she is not calling upon anyone to gather,” he said.

The State alleges that on June 3 this year, Kuveya incited Chitungwiza residents to resist the move by the council to remove informal traders operating from road servitudes.

It is further alleged that Kuveya recorded a video which she posted on social media in an endeavour to incite residents and informal business traders in Chitungwiza to resist demolitions of illegal structures, and to incite residents to revolt against council.

Musarirevhu had cited Zengeza West Constituency legislator Job Sikhala’s case as his defence outline where he was once accused of plotting to overthrow President Emmerson Mnangagwa’s government, in which the MDC Alliance politician was acquitted.

However, magistrate Matova yesterday argued that the defence had jumped the gun since Sikhala’s case was on trial stage and not remand.
