At least 93 Kwekwe Polytechnic students have petitioned the High Court to compel the institution to release their electrical engineering and diesel plant fitting results, which were withheld over allegations that question papers were leaked.
The students further said they are also seeking another order to interdict Higher Education Examination Council (Hexco) and Kwekwe Polytechnic from compelling them to re-write the examinations.
In their court application, through their lawyers Dube, Manikai and Hwacha legal practitioners, the students cited Hexco and Kwekwe Polytechnic as the first and second respondents, respectively.
In his founding affidavit, one of the students, Hamilton Mupandenyama, said Hexco and the college are acting on unproven allegations.
“This is an application seeking a two-pronged relief, firstly, a compelling interdict for the release of the applicants’ (students) Hexco national certificate examination results in electrical engineering and diesel plant fitting and secondly, a prohibitory interdict against a rewriting of the examination in automotive and electrical engineering intimated by the respondents,” Mupandenyama said.
In his chronological order of events Mupandenyama said the students wrote the examinations between March and April this year and when they went to collect their results they were advised by the examination office at Kwekwe Polytechnic that their results could not be released because the exam paper had leaked, because some students had allegedly had unauthorised access to the paper prior to the examination.
“On June 4, 2019, the second respondent (Kwekwe Polytechnic) then began sending phone text messages to some of the applicants informing them that following the investigations, there was going to be a re-write of the examination paper in electrical engineering and automotive engineering,” he said.

“Quite interestingly, most of the affected students did not receive this text message and only obtained it from those that had received it such that there has been a lot of confusion and disharmony among the students. This is the other reason why applicants could not approach the court much earlier, because there has not been any official communication from the respondents regarding the matter.”
The students further said the conduct by Hexco and the technical college to withhold the results was unjustified and prejudicial.
The matter is pending.
