Doubt Ncube (26) was initially charged with rape when he appeared before Hwange senior regional magistrate Collet Ncube on Friday.

After a full trial, the charge was reduced to only indecent acts on a young person due to insufficient evidence to secure a rape conviction and he was convicted of the lesser charge.

The magistrate sentenced him to 40 months in jail.

Ten months of the sentence were suspended for five years on condition of good behaviour.

Tompei Mbiza told the court that on May 18 this year at 12 midday, the girl was going to a borehole close to a business centre.

She met Ncube, who greeted her and asked to have sexual intercourse with her, but she refused.

He promised to give her $1, but she did not accept the offer.

Ncube then started to threaten to kill the girl if she ever alerted anyone about the issue.

He then ordered her to leave the borehole and he forcemarched her into the bush, where he stripped her naked and it was the State case that he raped her.

The court heard that Ncube was found with the girl in the bush by her brother, who had started looking for her. A report made to the police led to Ncube’s arrest.
