A LOCAL property firm, Innovent Zimbabwe (Pvt) Ltd t/a Qrent Zimbabwe, has dragged the Municipality of Gwanda to court seeking to compel the local authority to settle a $14 508 rental debt.

Qrent Zimbabwe issued summons against Gwanda Municipality for provisional sentence after the latter acknowledged owing the firm, but failed to fulfil its acknowledgement of debt since September last year.
“The plaintiff’s (Qrent Zimbabwe) claim is for provisional sentence in the amount of $14 508,09 with interest thereon at the prescribed rate of interest from September 8 2016 to date of payment in full,” the firm said through its lawyers Dube, Manikai and Hwacha.
“The plaintiff’s claim against defendant (Gwanda Municipality) is based on a liquid document in the form of an acknowledgement of indebtedness which was sent via email by the defendant, represented by Mr Xolisani Dube, to the plaintiff on January 30, 2015.”
The firm said in terms of the acknowledgement of debt, the municipality acknowledged owing $23 621,09 in respect of arrear rentals and proposed a payment plan to settle the debt.
“The arrear rentals arise from breach by the defendant of a master rental agreement entered into between the plaintiff and the defendant on March 15, 2012,” the firm said.
“Despite undertaking in the acknowledgement of debt to repay the amount of $23 621,09 by December 2015, the defendant has to date only made payments amounting to $10 500. The balance outstanding as at February 20, 2017 is $14 508.”
