In its summons, the council submitted that the church had accumulated the debt at its premises at number 104 George Silundika Road. The local authority also demanded interest on the sum at the prescribed rate from the date of summons to the date of payment and costs of the suit.

In its declaration, the local authority submitted that the outstanding debt had crippled its operations and compromised service delivery.

“The defendant is the owner of an immovable property known as NO 104 George Silundika Street Bulawayo, situated within the City of Bulawayo, although the said property is still registered in defendant’s former name of Hatrix (Pvt) limited.”

The council said the defendant has not been paying its service charges and has to date accumulated arrears amounting to $54 921, 21.

“Defendant has failed and or refused to pay as will more hereto which is a running account for services charges, on the said property, maintenance by the plaintiff,” the council submitted.

The local authority prayed for an order compelling the church to settle the amount with interests and costs of the suit as prescribed. The church is yet to respond to the summons.
