AN estranged Victoria Falls woman has approached the courts seeking an order compelling her ex-husband’s employers to provide a list of his immovable assets to enable her to claim a share of the properties.

Thulisiwe Prudence Moyo filed the application at the Bulawayo High Court citing her ex-husband Ngqabutho Moyo, and his paymaster, Victoria Falls Municipality, Additional Deputy Sheriff and Bulawayo deputy registrar as respondents, respectively.
In her founding affidavit, Thulisiwe said her application sought to authorise the Additional Deputy Sheriff to obtain from the town clerk and Victoria Falls Municipality all information and documentation concerning any immovable property currently and previously allocated to her ex-husband within the last five years.
“The third respondent (Ngqabutho) issued summons for divorce against me out of this court on November 10 2015. I entered an appearance to defend on November 18 2015 and filed my plea on November 20 2015. Subsequently third respondent filing his replication, I filed a notice of amendment of plea to include in my plea further property to be shared between the third respondent and I upon divorce on January 2016. The third respondent was not averse to the amendment and filed his supplementary replication in that regard wherein he denied the existence of the three stands forming the bases of my claim and the application,” read the founding affidavit.
She said the town clerk also declined to disclose the information about Moyo’s assets, notwithstanding the fact that the information was needed to further the course of justice in the divorce case. She said the information requested is critical to her case and the refusal by the respondents to declare the information militates against her rights to know the property they have to share.
The respondents are yet to respond to the application.
