Zinwa filed the summons against Louville Estates last month demanding the payment of $44 497,76 citing breach of agreement.

“Plaintiff’s claims against defendant are for payment of sum of $44 497,76 being the sum owed by defendant to plaintiff for water abstracted as at per agreement signed by both parties the plaintiff and the defendant,” the summons read.

Zinwa contends that the two parties entered into an agreement for the provision of water and further went into an agreement that defendant would pay plaintiff $47 000 and further $44 497,76 over a period of two years after which an interest of $49 604, 91 would be written off.

The defendant was supposed to pay and despite demand the defendant neglected to pay.

To date, Zinwa’s claims shows that $44 497,76 is still outstanding. However, the company has filed a request for further particulars over the case.

“To enable the defendant to plead to the plaintiff’s declaration, the following particulars are required, who is the defendant in the matter, how is the sum of $47 000 arrived at if it is for water bills, a breakdown of same is required indicating the dates when it was due and payable. When was the sum of $44 409, 76 due and payable and how did it arise,” the company demanded.

Zinwa is yet to clarify the requested particulars to the estate agent.
