Themba Nyoni (49) was arrested and charged after an altercation with Rural Development, Promotion and Preservation of National Culture and Heritage minister Abednico Ncube.

Incensed by Moyo’s statement that Mugabe was old, Ncube caused the former councillor’s arrest.

Zimbabwe Lawyers for Human Rights member, Lizwe Jamela confirmed that prosecutor, Blessing Gundani had refused to prosecute the matter.

“Area prosecutor, Gundani refused to prosecute the matter, saying it was not clear how the alleged remarks constituted an offence and advised that the matter will proceed by way of summons,” he said.

“We did not even appear before any magistrate.”

Ncube is alleging that on an undisclosed date this year, the former MDC-T councillor, now retired from politics, said: “I will not join Zanu PF. Go and tell Mugabe that he is now old. We no longer want him, he should step down.”

This was reportedly in retaliation to Ncube, who made fun of MDC-T leader, Morgan Tsvangirai, describing the former Prime Minister as “politically finished”.

Nyoni also insisted that the minister was always courting him to join Zanu PF whenever they met.
