In summons filed at the Bulawayo High Court on February 2 this year, the university claimed the engineering company had failed to fulfil its terms of the agreement, hence, the demand for a refund.

“The plaintiff’s claim is for payment of $16 000 being a refund due to plaintiff by the defendant following the cancellation of an agreement between the parties,” read the summons.

“Interest thereon at the prescribed rate of 5% per annum from the date of service of the summons. Costs of suit and on the legal practitioner and client scale in the event that the matter is contested.”

In its declaration of the claim, LSU submitted that sometime in November 2015, it engaged the company to supply and fix chairs for two lecture theatres.

“The defendant was given an advance payment of $16 000 by the plaintiff. The defendant has failed to deliver on the agreement between the parties, which agreement, hereby, cancel. In the circumstances the defendant is obliged to refund plaintiff the $16 000 paid.”

Winnerman Engineering Company is yet to respond to the summons.
