Provincial magistrate Vakai Chikwekwe yesterday dismissed an application for refusal of remand filed by First Class bus company owner Simbarashe Gibson, who is facing charges of aggravated indecent assault.

Gibson was arrested after he allegedly sexually attacked his female cousin and detained her from October 9 to 28 this year at his Harare residence.

The magistrate then asked the State to provide more details of the alleged abuse. The State called the woman to the witness stand to testify after the defence had raised an objection, arguing the charge sheet did not have the complainant’s name.

The complainant (name withheld) told the court Gibson was her cousin and that on the day in question, he contacted her at 8pm requesting her to report to his office.

She said upon entering the office, Gibson opened his desk drawer and took out a silver shotgun, which he pointed at her.

She further said Gibson force-marched her to his office bedroom while pointing his gun on her back and she was actually shocked by his behaviour.

“He ordered me to kneel down while pointing his gun on my chest and I complied, after which he told me to open my mouth or else he would shoot me. I then complied up until he finished abusing me,” the woman said. “He asked me if I was going to report and I kept quiet and he took me to an unknown place from October 9 to 28 and I managed to report the case at Makomva Police Station in Glen Norah.”

In his ruling, Chikwekwe said there was reasonable suspicion to put Gibson on remand since the woman had told the court the story under oath.

Chikwekwe remanded Gibson in custody to November 16, while at the same time waiting for confirmation of a warrant of arrest from the National Prosecuting Authority.
