Nyoni allegedly owes Zimbabwe Farmers’ Development Company (ZFDC) $81 900 for dump trucks acquired in 2008, but were not fully paid for. Mutasa, now a leading member of the opposition ZimPF, allegedly owes Zimbabwe Leaf Tobacco Company (ZLTC) $81 137,08.

Both companies have separately approached the courts to recover the debts.

Mutasa’s case is set to be heard tomorrow in the motion court before High Court judge, Justice Amie Tsanga, while Nyoni is yet to enter an appearance to defend notice.

According to the summons issued on September 26 this year, under case number HC9732/16, Nyoni, a Zanu PF politburo member, is said to have acquired two dump trucks sometime in 2008 from ZFDC, but did not pay the full amount for the lorries, prompting the company to approach the courts for recourse.

The full details of how Nyoni acquired the trucks were not provided in the court papers, where only a single-page summons was filed.

Attached to the said summons is a funds transfer form from the now defunct Agricultural Development Bank of Zimbabwe (ADBZ) showing part of the amount that was transferred as part payment for the said trucks in Zimbabwe dollars.

“The plaintiff’s (ZFDC) claim is for: Payment of the sum of $81 900 in respect of a 10-tonne dump truck sold by the plaintiff to defendant (Nyoni) at Harare and delivered to the defendant at the defendant’s specific instance and request,” the summons issued against Nyoni read in part.

According to the information contained on the ADBZ transfer form, the minister instructed the bank, on February 28, 2008, to transfer ZW$16 646 400 000 from a company called Pesin Investments Fountains Farm and to deposit the cash into a ZFDC account, as “part payment for two by new dump lorries”.

According to the ZLTC, Mutasa’s debt had become due and payable because he allegedly failed to abide by the deed of settlement by failing to make full payment of the first instalment of $47 531,99 on July 31 this year.
