Charumbira is being sued by Steward Bank on behalf of TN Harlequin Luxaire.

In its founding affidavit, Steward Bank claims Charumbira incurred the debt sometime in 2012, when he bought furniture on credit from TN Harlequin Luxaire. The furniture manufacturing firm then ceded the debt to the bank, thereby, transferring its rights to claim money to the financial institution.

Charumbira was issued with the court summons last Tuesday under case number HC10536/16 and is yet to enter an appearance to defend notice.

“TN had entered into an agreement of sale in which the defendant (Charumbira) purchased two sets of furniture articles worth $12 762 on November 17, 2012 when the agreement was concluded,” the bank said.

“Defendant was to settle his indebtedness by making payments in the form of monthly instalments to the plaintiff (Steward Bank) for a period of 24 months and in the event that the defendant defaulted on payments, he was liable to paying the full outstanding balance.”

The bank further said Charumbira was still in possession of the furniture and had only made two occasional monthly instalments amounting to $600.

“To alleviate his indebtedness, the defendant only made two sporadic payments, the first being the sum of $300 on October 23, 2013 and the other on January 21, 2014, which was not sufficient to significantly reduce the debt, let alone to settle it and, as such, the defendant has failed to service his account,” the bank said.

“Despite demand, defendant has neglected and/or refused to pay the balance to settle his indebtedness.”
