The Prosecutor-General’s (PG)Office has asked lawyers representing director of public prosecutions Florence Ziyambi to formally assume agency in a case in which they are seeking a private prosecution certificate against the Zimbabwe National Army’s Colonel Solomon Siziba.

Ziyambi, through her new lawyers, had written to acting PG Advocate Ray Goba seeking to be granted a private prosecution certificate since his office was refusing to prosecute the senior military officer on assault charges emanating from a clash in the office in 2015.
Siziba is the National Prosecuting Authority (NPA) head of administration.
Suspended PG Johannes Tomana declined to prosecute, prompting his junior to seek private prosecution.
The PG’s Office, in a letter dated September 16, 2016, acknowledged receipt of the letter from Warara and Associates, but told the law firm that it had not properly assumed agency in the matter.
The letter from the NPA stated that they had not been formally notified that Ziyambi had changed lawyers from Mbano and Associates who last represented her in the matter.
A source at Warara and Associates confirmed the response from the NPA.

“It’s true we received the response and we are working on regularising our assumption of agency as requested,” the source added. Charles Warara, the principal partner at Warara and Associates, was not immediately available for comment.
Warara successfully privately prosecuted former Bikita West MP Munyaradzi Kereke for raping a minor.
Kereke is now serving 10 years at Chikurubi Maximum Security Prison.
