A HARARE man, who was raised by his late uncle and aunt, is allegedly threatening to chase the late couple’s only daughter from their home, claiming to be their biological son.

The matter came to light at the Civil Court yesterday, when Alice Muteno made an application for a protection order against Simon Simba, whom she said was in the habit of assaulting and chasing her away from her late parents’ Mbare home.

Muteno told the court that despite her being an only child and sole inheritor of her parents’ estate, Simba, her cousin, was now chasing her away from her parents’ house.

“I was born as the only child to my parents and Simba is my cousin from my paternal side,” Muteno said.

“I think he is claiming inheritance because he was raised by my parents.”

When asked to respond, Simba, who was in possession of his birth certificate, denied physically abusing Muteno, but refuted that the two were cousins.

“I am her biological brother, she was born seven years after me and, therefore, it is only fair that we share the house,” he said.

Simba further told the court that, all along, he had been renting somewhere, but now wished to stay at his “parents’ house” because he could no longer afford rentals.

However, Muteno denied being of the same blood with Simba, saying his real mother was alive and willing to testify. “He is not my ‘blood’ brother, his real mother is in Waterfalls and can come to confirm this to the court,” she said. Presiding magistrate Gamuchirai Siwardi will pass a ruling today.
