According to the summons issued by Madondo against ZHC under case number HC7531/16, the judicial manager said he was appointed to manage the firm in June 2008 in pursuit of a High Court order under case number HC7438/06.

Pursuant to his mandate, Madondo said he undertook his duties until his resignation due to lack of co-operation from the shareholders and the beneficiaries of the stands.

“On April 30, 2009, the plaintiff (Madondo) obtained a taxed bill of costs in the sum of $15 793 in respects of its services. The bill of costs now stands at $22 388, 67 due to the compounding of interest,” Madondo said in his declaration filed together with the summons.

“The plaintiff has made several demands for the payment of the said amount, but despite demand the defendant has failed, neglected and or refused to pay the amount due.”

However, ZHC, last week entered an appearance to defend notice giving an indication that it is prepared to challenge Madondo’s claim, as and when the matter would be set down for hearing.

In his declaration, Madondo said he had been left with no option, but to resort to legal proceedings to recover his money after the firm failed to pay for his rendered services.

“The plaintiff is thus claiming costs in full in terms of the legal practitioner client scale or collection commission,” he said.

The matter is still pending at the High Court.
