Peter Nyamitambo (23) was found guilty of driving an un-roadworthy vehicle, which resulted in one Tichaona Chifamba losing his arm.

According to the State‘s particulars of negligence, Nyamitambo was found guilty of overtaking on the wrong side of the road, driving at an excessive speed in the circumstances and failing to control his vehicle.

Nyamitambo was initially sentenced to a nine-month prison term by Chitungwiza magistrate Rekina Dzikiti, but three months were suspended on condition of good behaviour.

Circumstances leading to Nyamitambo’s arrest were that on January 29 this year, he was driving a Leyland Truck behind a Toyota Hilux commuter omnibus along Chaminuka Road in St Mary’s, Chitungwiza.

Upon approaching a speed hump close to Total Service Station, the court heard, Nyamitambo overtook from the left side and in the process side-swiped the commuter omnibus, injuring Chifamba, whose left hand was suspended through the window.

Chifamba’s hand was later amputated at Chitungwiza Central Hospital. Tatenda Mukatera prosecuted.
