Justice Amy Tsanga agreed with car owner Raymond Madamombe that the police had violated the Constitution by continuing to hold his vehicle since February 24 without any legal explanation.

Madamombe contested the seizure of the vehicle through his lawyer, Elias Mapendere.

In case HC2226/16, Madamombe had argued that the car belonged to a driving school and was impounded when a driving instructor, Freddy Chitora, was dropping a learner driver close to his office.

“In the process, Chatora was arrested by the police officers for dangerous parking,” he submitted. “He was taken to Rotten Row Magistrates’ Court, where the prosecutors directed that he should pay a fine at the police station, which he paid.”

Police then took the car and parked it at Chikurubi Support Unit Police Camp refusing to release it even after being furnished with documents proving that the car belonged to the driving school. Madamombe, in his papers, claimed he had lost business worth $100 daily since the vehicle was impounded.
