Rachel Pedzisai, through her lawyers Musemburi and Muchenge, is demanding that Simbarashe Vorontiya, Trade Access, Ishmael Mangwanya, Joseph Band, Luna Chickens and George Mashonganyika restore her vehicle they were illegally possessing. She was also demanding $4 920 being loss of income incurred due to their action of possessing her car illegally.

According to Pedzisai, she bought the vehicle from Vorontiya in 2012 “albeit acting upon representation that the vehicle was his”.

She alleges that Luna Chickens was aware of the disposal of the said vehicle and the action of the company to repossess the vehicle was illegal.

Pedzisai stated that she wants the defendants to pay her an extra sun of $60 per day from September 1, 2014 to the date of restoration of the vehicle “being loss of income” on top of the vehicle and a sum of $4 920.

One of the respondents in the matter, Mangwanya, stated in his response to the summons that he had no relation “whatsoever to the plaintiff and accordingly is not obliged to give any account of the vehicle”.

“In any event, the third defendant (Mangwanya) did not dispossess plaintiff of any vehicle. He was not even present when this happened, neither did he authorise its taking. As such, he cannot be liable for actions of third parties,” he stated in his papers filed by Kachere Legal Practitioners.

Luna Chickens is yet to file the opposing affidavits to the claim.
