A BINDURA University student, whose arm was fractured while allegedly being beaten by police officers in July last year, has taken Home Affairs minister Ignatius Chombo and Police Commissioner-General Augustine Chihuri to the High Court seeking over $51 000 in compensation.

Luckson Munyai filed the summons on Wednesday this week under case number HC1286/16 in which he also cited Inspector Mutizwa and Sergeant Nleya, both stationed at Kadoma Rural Police Station, as third and fourth respondents respectively.
According to Munyai, the incident leading to the lawsuit occurred on July 17 last year when he was in the Svikiro area of Patchway in Kadoma while in the company of his colleagues fetching and cutting firewood.

“At that juncture, a police pick-up vehicle carrying police officers suddenly stopped by the roadside and a group of police officers in police uniform jumped out of the car. They ordered the plaintiff (Munyai) and his companions to lie down on their stomachs and they complied,” Munyai said in his declaration.
“The police officers then started assaulting the plaintiff with a log all over his body several times. Plaintiff sustained a fractured right arm and chest tenderness due to the assault and after the assault, they ordered him and his companions to vacate the scene.”
Munyai said as a result of the assault, he incurred medical expenses in the sum of $1 503 including costs of transport and employing a personal aide and accommodating the same.

“The plaintiff is a student at Bindura University and as a result of the above he spent four months with a plastered hand in which case he was no longer able to perform the usual duties expected of a student and had to employ a personal aide to assist with bathing, laundry and cooking and had to secure extra accommodation for the personal aide,” he said.
“Plaintiff suffered damages in the sum of $51 503 as a result of the assault.”
The cited respondents are yet to file appearance to defend notices.
