A HARARE woman yesterday broke down in tears before collapsing while making an application for the custody of her two minor children.

Florence Gwenya wept after presiding magistrate Reward Kwenda indicated there was need to postpone the matter to enable the court to hear more facts and also have the children’s testimony.
However, Gwenya did not take the postponement lightly, insisting the matter should be treated with urgency because her children were suffering without her.
“I cannot come back on another day because my children are living a miserable life. My eldest child has stopped attending school since October 9,” she said.
Gwenya provided a letter from the child’s school to prove the child had not been going to school.
Earlier, Gwenya had told the court she separated with her husband, Freddy Nyamukondiwa, in August this year when the latter took her to her parents’ home following some differences.

The woman also told the court Nyamukondiwa was now living with another woman and no longer wanted any communication with her.
However, Nyamukondiwa, through his lawyer, opposed Gwenya’s application, arguing the former was a drunkard and was the one who had deserted the couple’s matrimonial home.
The magistrate eventually postponed the matter to Monday next week for continuation and after Gwenya regained consciousness, the court advised her relatives to accompany her back to court on the next hearing day.
