The matter was supposed to be heard yesterday before High Court judge Justice Happious Zhou but the council filed its papers late in the day, prompting its postponement to today.

The residents, Frazer Zvangundega Dube, Nelly Ndlovu and Beauty Sande, represented by Sharon Hofisi from the Zimbabwe Lawyers for Human Rights (ZLHR), also want the council to be stopped from billing them until their matter has been determined.

“We appeared today and the respondent (council) filed its notice of opposition and heads of argument.

“We will be back in court tomorrow (today) for submissions and we are likely to file supplementary heads before arguing the matter,” Hofisi said.

It also emerged that Combined Harare Residents Association and Community Water Alliance had also filed separate affidavits in solidarity with the affected residents.

The three residents claim their water was disconnected sometime in June this year, despite council officials not having a court order granting them authority to do so.

They argued the council’s actions violated their constitutional right to access clean, portable water.
