Mama MaFuyana Housing Co-operative of Harare North, through its chairman Boniface Mutize, has applied for a peace order against the Cabinet minister.

In an application filed at the Harare Civil Court, Mutize wants the courts to interdict and restrain Chikwinya from any activities which could render their co-operative non-functional.

Mutize said Chikwinya was allocated a separate land portion in the area, but had “become a nuisance through interfering with the pegging of stands… that is removing pegs done by the Surveyor-General on 109 stands allocated to the Ministry of Local Government”.

“Despite being allocated a stand, the respondent (Chikwinya) has become a nuisance by: stopping the applicant from using electricity and water at the property in question,” Mutize said.

According to court papers, Mama MaFuyana Housing Co-operative was allocated the remainder of Glen Forest of Borrowdale Estate in 2011 for residential purposes.

The co-operative members claimed that Chikwinya grabbed part of the property which they had been allocated and blocked Mutize access to his stand which is 500 metres from her residence.

Chikwinya has until July 31 to file her opposing papers before the matter is heard by a magistrate.

The housing co-operative is represented by Tavenhave and Machingauta Legal Practitioners.
