Harare magistrate Tendai Mahwe is presiding over the theft of trust property matter. Chimbodza told the court he was still friends with Marenge whom he had a business deal with in the past although it later turned sour.

According to Chimbodza, the said deal took place in October last year, but Marenge allegedly failed to keep his word on the same.

“Marenge owed me $3 500 and had my car, a Mercedes-Benz ML 430, which I had asked him to sell on my behalf, but he did not bring the money or the car back,” Chimbodza said. Chimboza further told the court that during the said period when Marenge was supposed to sell the car, he (Chimboza) was using the latter’s Toyota Ipsum which was later seized by the police under unclear circumstances.

“I used his Toyota Ipsum that was taken by police and he gave me another vehicle to use in the interim, a Toyota Granvia, but that car was also taken away from me before the agreed time had lapsed,” he added.

As the trial progressed, prosecutor Idah Maromo tendered to the court an affidavit authored by Marenge as an exhibit of the agreement which the two parties had entered into.

“The agreement stated that I was to use the Granvia until March 14, 2015 by which time Marenge would have returned my Mercedes-Benz ML or failure to do so, would result in me getting the Granvia as a replacement,” Chimbodza said.

However, during cross-examination an unrepresented Marenge only managed to ask Chimbodza if there were any witness to the deal to which the latter responded: “There were witnesses, but they did not append their signatures to the affidavit.”

The trial continues today.
