In passing sentence yesterday, High Court judge Justice Joseph Musakwa said he had spared the convict, Aleck Majari, from a lengthy prison term since the latter paid compensation to the now deceased Ndangariro Moyo’s family and spent over two years in remand prison awaiting trial.

However, the judge castigated Majari’s behaviour, of celebrating after stabbing Moyo to death, which he said would not be tolerated, but compensated with a jail term.

“The accused person (Majari) claimed he had finished the job and had the deceased’s T-shirt around his shoulder exhibiting a trophy soon after stabbing the deceased,” Justice Musakwa said.

Prosecutor Washington Munyoro presented that on April 18 2011, Majari and his friends were drinking beer at Hobwe business centre when Moyo and his brother Agrippa Elphias arrived.

The court heard that when Moyo proceeded to the shop’s veranda to smoke, Majari confronted him over the $10 debt and the two had a misunderstanding which resulted in a physical confrontation.

Justice Musakwa heard, Majari head-butted Moyo, who retaliated, but upon realising that he would not stand the fight, Moyo took to his heels and sought refuge in the bar, but Majari folowed him baying for his blood.

Later, the court heard, when Moyo got out of the shop Majari stabbed him once in the chest before seizing his T-shirt as security for his cash.

After stabbing his victim, the court heard, Majari wore Moyo’s T-shirt and went back to the bar where he “boasted of having finished his job” before other patrons effected a citizen’s arrest and handed him over to the police.
