HARARE High Court judge Justice Mary Zimba-Dube yesterday dismissed an application by three residents from Dema Growth Point who were seeking an order to bar Manyame Rural District Council from demolishing their buildings claiming such an action would be an infringement of their constitutional rights.

Justice Dube said there were material disputes of facts on whether the council had destroyed homes and not just building structures.

Musoko village head Michael Dzikiti, Paradzayi Chipato and Philip Mbengeranwa last year applied to the High Court seeking an order to stop the demolitions after council had embarked on a blitz targeting illegal structures.

Through its lawyer Advocate Thabani Mpofu, the local authority argued that the structures had been built without council’s consent.
