Man caught ‘raping’ brother’s pregnant wife


A 19-YEAR-OLD Chitungwiza man who was caught having sexual intercourse with his brother’s wife appeared in court yesterday facing rape charges.

Shingirai Moyo of Unit F, Seke, denied three counts of rape charges when he appeared before Chitungwiza regional magistrate Estere Chivasa.

Moyo, through his defence Lawyer Karen Muyangwa of Muronda and Muyangwa Legal Practitioners, denied the allegations, saying that he had consensual sex with the 23-year-old complainant on three occasions after she had seduced him.

“With regard to the first count, the accused person and the complainant had consensual sex after the complainant had awakened him in his room.

“In respect of count two, it is the same as the first count and on count three, the complainant called the accused into her room and had consensual sex, but was caught in the act by the accused person’s sister. Therefore, the accused person will deny the allegations,” Moyo’s lawyer said.

Circumstances in the matter are that sometime in January this year, the complainant who had gotten pregnant, eloped to Moyo’s elder brother, Kelvin, who resides at Riverside, Dema.

The brother, however, has another wife and the complainant was made to stay with her mother-in-law and the accused person in Unit F, Seke.

The court heard that the accused person proposed love to the complainant, but he was turned down.

It is alleged that one day, the complainant was alone in the kitchen cooking when the accused person entered and locked the door.

Moyo then allegedly pinned the complainant to the ground and raped her without using protection.

On the second encounter, the complainant was alone at home in the kitchen again when the accused person entered the room and pushed her to the ground.
The court heard that she tried to fight him off, but was overpowered and the accused person raped her.

The complainant screamed, but Moyo stifled her screams.

It is further alleged that on a day not known to the prosecutor at around 9pm, the complainant was alone in her room lying on the bed when the accused person entered.

The accused person then had sexual intercourse with the complainant without her consent, but was caught in the act by the his sister.

Prosecutor Lovett Muringwa told the court that the complainant was chased away by her mother-in-law for having “wreaked havoc in their family”, causing Kelvin to hate Shingirai for sleeping with the former’ wife.

In April, the complainant’s grandmother accompanied the complainant to the police and made a report, leading to Shingirai’s arrest.

Magistrate Chivasa remanded the matter to Monday for continuation of trial.
